Q1  What is occurring with regard to the Canada/NDI Agreement?

  • An agreement has been reached between the Department of Fisheries and Oceans (DFO) and Nautical Data International (NDI) for DFO to buy back its rights under the Revised Canada/NDI Agreement (“RCNA”) from NDI.

  • The closing date for the buyback agreement is March 30, 2007.

  • The terms of the buyback agreement are confidential.

  • The buyback agreement allows for an orderly transition to CHS of NDI’s current responsibilities under the RCNA.


Q2  What is the Canada/NDI Agreement?

  • The RCNA is a copyright licence agreement between DFO and NDI for the distribution of Canadian Hydrographic Service (CHS) electronic charts and data. 


Q3  Does this mean the lawsuit by NDI against DFO will be dropped?

  • Yes. As part of the agreement to buy back rights under the agreement, DFO and NDI have settled any outstanding legal disputes.


Q4  Why is DFO buying back its rights under the RCNA?

  • DFO and NDI have agreed that it is no longer in their best interests to continue with the RCNA.


Q5  How will this impact on the services and products previously available from NDI?

  • Up to and including March 30, 2007, continue purchasing digital charts and obtaining updates and technical assistance from NDI at www.digitalocean.ca

  • After March 30, 2007, CHS will assume responsibility for production, marketing, sales and distribution of its digital charts and data, including licensing value-added resellers and dealers.

  • Instructions on how to purchase digital products from CHS, become a dealer or a VAR or obtain technical assistance will be posted on the CHS website at www.charts.gc.ca after March 30, 2007.


Q6  Will products be available for the upcoming boating season?

  • Yes, up to and including March 30, 2007, buyers can continue purchasing digital charts and obtaining updates and technical assistance from NDI at www.digitalocean.ca

  • After March 30, 2007, CHS will assume responsibility for production, marketing, sales and distribution of its digital charts and data, including licensing value-added resellers and dealers. 

  • Instructions on how to purchase digital products from CHS, become a dealer or a VAR or obtain technical assistance will be posted on the CHS website at www.charts.gc.ca after March 30, 2007.


Q7  What happens to the inventory of NDI dealers and VARs?

  • NDI will continue to respect and support their dealer and VAR licences until March 30, 2007.

  • On March 30, 2007, existing dealer and VAR licences will be assigned to CHS, which will continue to respect and support these licences.

  • Dealers and VARs may continue to sell their inventory after March 30, 2007. 


Q8  Which products are safe and meet legal requirements?

  • CHS digital nautical charts as distributed by NDI and CHS are safe and meet legal requirements for carrying charts on board vessels.

  • However, there continue to be infringing products on the market which may not be safe, and do not meet legal requirements for carrying charts on board vessels.

  • For a complete list of authorized manufacturers and products, please go to www.charts.gc.ca.


Q9  What are the terms of the agreement and how much did taxpayers pay for this?

  • The terms of the buyback agreement are confidential.


Q10 Will this have any impact on paper charts and publications?

  • All CHS paper charts, publications and updates will continue to be available as usual.


Q11 What will be the effect on NDI employees?

  • NDI, utilizing the expertise of its team, intends to continue serving the marine information market independently of the exclusive relationship with DFO and does not expect to cut any jobs.


Q12 Will the copyright infringement litigation commenced by NDI against C-MAP and Navionics continue?

  • NDI will continue with its copyright infringement litigation against C-MAP and Navionics. DFO will provide all reasonable assistance to NDI in respect of this litigation, and will not forgive or waive any infringing actions which may have been taken by C-MAP or Navionics prior to March 30, 2007.
